Many people consider buying a home one of the most important decisions they’ll make in their lives. It certainly requires a considerable financial commitment. So what happens when the seller decides to back out of the deal? Reasons for judgment were released on January 31, 2014 by Madam Justice Warren in a case where I represented a buyer who faced that very scenario. The Court awarded $37,400.00 plus interest and costs to my client after a four day trial. The decision is a worthwhile read of the remedies available in real estate breach of contract cases. It also shows the importance of retaining a lawyer promptly during the first signs of a collapsing deal.
